We Had TRESPASSERS At The Old Station
Today we discovered we had trespassers at The Old Station and they had destroyed some of our garden, unfortunately these vandals may have thought what they did was legitimate! If you can help us find out who the trespassers were we would really appreciate it.

    Hi there Have you thought about finding out if the other building is available because it would make a nice addition to the old station having it back with the station? I think it would be nice to link the two again, like when it was a running station with trains 🚆, I look forward to watching your progress. Good luck

    Maintenance easements. There will be an agreement in place which gives the owner of the bridge the right of access to maintain an easement either side of the bridge. You should have been made aware by your solicitor at time of purchase. There should be an asset number tag on it somewhere. As a road bridge the most likely the local highway authority.

    @ianwilliamson7703 3 дня назад

    It would have been local authorities, keeping the bridge clear and safe, they probably didn’t know the old station was occupied, normally, they will give you heads up, if they need to go on your property.

    Hi, you will find that there is "Way leave agreement is in place" the local authority have right if access to either side of the bridge for a distance,which is not fixed. To maintain the bridge and if necessary remove any trees and or bushes that the growth of may adversely affect the bridge. . I think they may also have a right of access through your entire property. . Your solicitor should have adviced of this.

    I just rewatched this episode to show my girlfriend the progress. She suggested why don't you get more cameras and put them over that way incase whoever it was comes back? You can catch them then if they aren't official. Also I was thinking of it was council then why didn't anyone check the updated tenancy and ask if they could do the work.

    Your visitors are National Highways, who took over responsibilty for railway structures in September 2013. Their actions have been the subject of much debate and legal action over the past few years. They have reasonable rights of access to their property, but like everone else, they require planning permission to undertake any structural work. Check your property deeds cand boundaries carefully. It would seem your neighbour has erected a fence outside the bridge span. I dont think that any previous owner of the station would have been reckless enough to accept ownership or responsibilty for the bridge structure. This would include the space under it. To avoid further vandalism, you could speak to your local tree preservation officer for advice. You may consider applying for protection orders for certain trees, after which the National Higways would need to seek planning permission to cut down or even prune branches.

    I'd definitely be getting the twist out of your panties before talking to anyone about this. If you go in with that attitude you will likely get full force of any laws or other requirements you have as landowner in respect of the bridge and it's surroundings. In all probability this has been done for free because getting hold of hundreds of landowners is just not worth the hassle for the hundreds of structures they have to maintain. Any stupid enough tho stick their noses above the parapet (pun intended) might find themselves paying their fair share of the cost. Any repeat of clickbait / high and mighty attitude will lose you a sub.

    Hi, I own an old railway property too. And luckily have the original deeds from 1897, luckily, as land registry sometimes do not have the complete information. And in those deeds it mentions that the railway company does have and will have access to my land if required for various reasons. There has been no station here since 1927 but if they so wish they can enter to cut the trees on the sliver of land left behind my property, where the station used to be. This is not mentioned on the present modern deeds. I have had them legally checked and even though the original railway company is no longer in existence, network rail holds the rights to do so. On the plus side, when the present owner of the office unit next door tried to block off the end of the private road, out come said deeds as it mentions I have right of access at all times around the original station entrance. So maybe worth seeing if you can find the historical documents. Kew in London is a good place to start at the public records office. Carry on the good work

      And this is why sales involving railway deeds can be a nightmare. They usually have restrictions and rights of easement in them all geared towards the railway companies benefit. I suspect that the Old Station has deeds containing them. As I've said elsewhere they need to go back to their purchase solicitor and confirm the exact legal position BEFORE they can talk to any third party who carried out the work. Once a condition appears in deeds it is there for ever regardless as to what happens to the land further down the line.

    It could be Vale of Glamorgan council have been out and done this. However they should have had the courtesy to tell you they were doing it and checked the boundaries. I wonder if they did it so they could get to the foliage they have cleared off the bridge? Have you asked your local councillor for advice? They can be very useful in finding out the facts in cases like this.

    Try the highways agency. This is planned work and there’ll be a job number for the bridge (The bridge should also have an identification number), grid reference, plans, risk assessments, safe systems of work etc. they’ll also have had to check boundarys with the land registry so as not to trespass.

    • @Killerclown667

      My mother has a similar situation ongoing on an old railway that my father bought. Their line ran alongside 2 other lines which are owned by the old steelworks heritage centre. The centre had planned to clear their old railway line and had trespassed on my mother’s line, felling trees and driving excavators over a wide area. The heritage centre hadn’t carried out a survey or contacted the land registry. They went straight ahead thinking my mother’s property was theirs.

  • @RylanceStreet
    @RylanceStreet 6 дней назад

    Although you may own the land up to the face of the bridge there may well be a covenant in your property title allowing the bridge owner access for inspection, maintenance and repair. Or the bridge owner might be relying on general powers of access under the original railway Act of Parliament. Either way, the solicitor who acted for you when you bought the property should have drawn your attention to this. May be worth going back to them and asking them to clarify the exact situation. Since this should have been done when you bought the property there should be no further charge for this.

  • @BLAZERSEAMS

    Obviously the bridge itself (and foundation base) is not your property and looking at the "secret garden" it would be easy to think it had become a bit of a dump. However, I agree the bridge is a super view and perhaps you should make the effort (and probably expense) to clear it all to get the full view when in the garden ... and you got a free container!

  • @normamurray4450

    Although this was no doubt a shock, I guess you have to look at this way, at least as far as the bridge is concerned....one less job for you up to that point. It's the trespassing on your property that is invasive and concerning. I hope all works out to the good!

    I would be worried that the Highways Agencies are not planning to come and fill it in, as this seems to be the policy these days! The cost of rebuilding the bridge in it is needed will far outway the cost of filling it in now! Looks like its in good condition atm, so it maybe that they looking to do the work now, while its in good order! Highways Agency will be able to tell you! Strange that your solicitor didn't pick this up and point it out to you, when you were buying!?

    Surprised you made a whole video regarding the cleared land surrounding the bridge, even a complete novice should have realised that either; the Network Rail or the Highways Agency have a responsibilty to keep the bridge in good order. My personal opinion is, it would not be unreasonable to charge you 'the property owner' for the clearing the offending undergrowth...

    The property line of my previous home extended about 10m from my retaining fence down into a gully at the back, as was the same with neighbours either side. We each kept our bits clear of brambles etc, and planted natives to make it look nice. The gully reserve was owned by the council. One day, unannounced, council contractors weed-wacked a strip of about 20 metres from the retaining fence, not the boundary line. My neighbours and I complained to the council and they had to spend thousands replanting it all. They admitted they were in the wrong and that they were not allowed do to any clearing within private property boundaries, unless they agreed it with the owners first. Granted they had no access to the gully land without going though private property, but all they had to do was ask first. We would have pointed out the boundary lines and made sure they did not disturb the native plantings.

    Read the covenants in your legal documents. All historic Railway companies were very good at protecting their infrastructure, this work is normally perfectly legal, just because it’s your land dosnt mean they don’t have access to carry out maintenance.
